Learned counsel for the petitioner submits that the petitioner was appointed as Sports Officer in the Department of Sports & Youth Welfare on 11.09.1983 and stood retired from the post of Assistant Director Sport & Youth Welfare Department on 30.06.2021. He further submits that he has been denied the benefit of time bound pay scale as he is entitled for second time bound pay scale and third time bound pay scale and also fixation of pension and other retiral dues accordingly. He would further

submit that he has already made a representation before the respondents dated 28.03.2024 (Annexure P/12). He further submits that this petition may be disposed of with a direction to respondent No.3/competent authority to consider and decide the same in accordance with the relevant rules and law within any stipulated period as fixed by this Court.

Learned State Counsel submits that if the petitioner may file a fresh representation, the respondents shall consider and decide the same within the period as fixed by this Court.

I have heard both the counsel for the parties and on perusal of the documents available on record.

Looking to the limited prayed made by the petitioner, this Court is inclined to dispose of this petition reserving liberty in favour of the petitioner to submit a fresh representation before the respondent No.3/competent authority alongwith the necessary documents and copy of the petition within the period of 30 days from the date of receipt of copy of this order and on such representation being made, it is expected that Respondent No.3/competent authority shall take a decision on such representation within the period of 120 days from submission of such representation in accordance with the relevant rules and law applicable to the case of petitioner.

If any adverse order is passed against the petitioner, he may avail the remedy available under the law.

Accordingly, this petition is disposed of with the aforesaid observations and directions.
