1. Petitioner has filed this petition seeking for the following relief(s):-

“I) The Hon'ble Court may kindly be pleased to call for the entire records, relating to the case of the petitioner.

¶20

II) That this Hon'ble Court may kindly be pleased to direct the respondents to forthwith consider the claim of the petitioner for compassionate appointment in view of the policy dated 14/6/2013 and in light of the above mentioned grounds.

III) That this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondent authorities to provide compassionate appointment to the petitioner on the suitable post in lieu of her mother who died during his service tenure. IV) Any other relief which this Hon'ble Court may deem fit and proper may also be passed in favour of the petitioner together with cost of the petition.”

1. Learned counsel for the petitioner submits that the mother of the petitioner was working on regular basis on the post of Peon in contingency establishment with the respondent authority. She dies in harness on 23.08.2023. Since the petitioner being son of the deceased employee made applications for consideration of his case for appoint on compassionate ground on 11.10.2023 and 04.03.2024 (Annexure P/4 Colly.). He further submits that according to the State policy with regard to compassionate appointment, the family members of the employees’ working under the worked charged contingency establishment are also entitled for compassionate appointment. Therefore, at this stage, he submits that this petition may be disposed of directing the respondent authority to take decision on the applications made by the petitioner (Annexure P/4 Colly.).

1. Ms. Nupur Trivedi, learned State Counsel submits that the applications made by the petitioner would be decided in accordance with law within the reasonable period of time.

1. Having thus, heard learned counsel for the parties and on perusal of the record, this Court is inclined to dispose of this petition directing the respondents to take the decision on the applications made by the petitioner Annexure P/4 colly. on

compassionate ground within the period of 120 days from the date of receipt of copy of this order.
