Learned counsel for the petitioner submits that the petitioner is an employee of School Education Department and joined his services as Assistant Teacher on 28.02.1985 and ultimately retired on 31.03.2024 on attaining the age of superannuation. He further submits that as per Chhattisgarh Civil Services (Leave) Rules, 2010, the petitioner is entitled for leave encashment 240 days and the respondent No.4 has sanctioned only 195 days of leave encashment.

He further submits that the petitioner has already file a representation before the respondent ventilating his grievances as projected in the representation, he further states that this petition may be disposed of either with a direction to respondent or permitting the petitioner to make a fresh representation before the respondent in the time bound manner.

Learned counsel appearing for the respondent submits that he is having no objection to the limited prayer made by learned counsel appearing for the petitioner.

Be that as it may, after considering the submissions made by the both the parties at bar and after perusing the documents on record, this petition is disposed of, at this stage, without commenting anything onto the merits of the case, permitting the petitioner to make a detailed representation before the respondent No.2/competent authority projecting all his grievances as projected in this writ petition along with the copy of petition within 30 days from today and in turn respondent No.2/competent authority is expected to consider and decide the same within the period of 120 days from submission of such representation in accordance with the relevant rules and law applicable to the case of petitioner.

If any adverse order is passed against the petitioner, he may avail the remedy available under the law.

Accordingly, this petition is disposed of with the aforesaid observations and directions.
