1. By way of this petition, the petitioners have sought the following relief(s):-

10.1 The Hon'ble Court may kindly be pleased to quash the letter/list dated 27.09.2012 bearing No.Stha/2012/517 Bilaspur issued by the Joint Director, Health Services, Bilaspur Division, Bilaspur.

10.2 The Hon'ble Court may further kindly be pleased to direct the respondent State to follow the rules prescribed under the Rules of 1989 and thereby consider the case of the petitioners for promotion forthwith.

10.3 Cost of the petition may also be granted to the petitioners.

¶44

10.4 Any other relief which this Hon'ble Court deems fit and proper may also kindly be granted to the petitioners, in the interest of justice.

2. Learned counsel for the petitioners submitted that the services of the petitioners were regularized in the year 1990 on the post of Multipurpose Health Worker. He further submitted that the petitioners were eligible for promotion to the post of Multipurpose Male Supervisor in the year 2012 when the claim of the other similarly situated persons was taken into consideration by the Departmental Promotion Committee. He also submitted that the petitioners have not got a single promotion till date.

3. On the other hand, the learned counsel for the State submitted that if the petitioners are eligible for promotion and posts are lying vacant, the case of the petitioners would be considered.

4. I have heard learned counsel appearing for the parties and perused the documents placed on the record.

Taking into consideration the limited grievance of the petitioners, at this juncture, the present petition is disposed of reserving liberty in favor of the petitioners to make representations before respondents No. 2 and 3 raising their grievances with regard to promotion and the concerned authority is directed to consider the claim of the petitioners in an objective manner preferably within a period of 120 days from the date of receipt of a copy of this order.

6. With the aforesaid observation(s) & direction(s), the instant writ petition stands disposed of .
