“ 10.1 the Hon’ble High Court may kindly be pleased to call for the entire records leading to the impugned in-action for its kind perusal.

10.2 Hon’ble Court may kindly be pleased to quash the advertisement published to fullup the post of Forest Guards. (AnnexureP-1).

10.3. Hon’ble Court may kindly be pleased to direct Respondent authority to absorb on the post of Forest Guards.

10.4 . Any other relief, which Hon’ble Court deems fit and proper may also kindly be granted to the Petitioner in the interest of justice.

out for hearing, therefore, this Court is left with no other option except to hear the case as the instant petition was filed in the year 2012.

3. Learned State counsel submitted that the petitioner was initially appointed as a daily wager in the year 1988 in the Forest Department and was working with the respondent department. Later on, his services were regularized by the department vide order dated 03.10.2008. He further submitted that an advertisement was issued for the post of Forest Guard on 25.08.2012. The petitioner filed this petition seeking appointment to the post of Forest Guard instead of the post of Chowkidar in which he was working at the relevant time. He also submitted that no interim order was passed in favour of the petitioner and the recruitment process was completed in the year 2012 itself. He further contended that the petitioner has not arrayed the selected candidate(s) as party respondent(s).

4. Admittedly, the petitioner was under regular employment of the forest department and at the relevant time, he was posted on the post of Chowkidar. Further, it is not stated in the entire petition that the petitioner had applied for the post of Forest Guard therefore, in the considered opinion of this Court; no case is made out for interference. Consequently, this petition fails and is hereby dismissed . No costs.
