Following relief has been claimed in this writ petition -

“10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent No.2 to consider letter dated 29/01/2022 (Annexure P/6) within stipulated period.

10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to consider the case of the petitioner as per memo dated 02/08/2019 (Annexure P/4) and 02/08/2023 (Annexure P/7) within stipulated period.”

Learned counsel for the submits that the petitioner is working as Data Entry Operator with respondents 3 and 4 on contract basis. He further submits that the petitioner is being paid a contract salary of Rs.13,776.00 per month. He submits that as per Finance Instructions No.22/2023 dated 02/08/2023 (Annexure P/7) has been issued by the Finance Department of the State Government according to which the petitioner is entitled to receive monthly contract salary of Rs.23350/-. He submits that seeking for enhancement of his pay, the petitioner made representation to his employer i.e. respondent No.3. Thereafter, a decision was taken in the meeting of the Directors of the Bank on 20/11/2020 to increase the remuneration of the District Education Officer and the same proposal was forwarded to the office of Registrar, Cooperative Societies, Chhattisgarh (respondent No.2). This has been again communicated by the office of District Cooperative Central Bank Maryadit, Raipur vide its letter dated 27/09/2021 (Annexure P/5) to respondent No.2/Registrar, Cooperative Society and further respondent no.4 has also communicated the same vide its letter dated 29/01/2022. Therefore, at present, the grievance of the petitioner would be redressed if respondent No.2 is directed to take decision on letter dated 27/09/2021 (Annexure P/5) and 29/01/2022 (Annexure P/6).

On the other hand, learned State counsel opposes the above submission.

From perusal of record, it appears that the petitioner was appointed on 25/03/2013 vide Annexure P/1 as Date Entry Operator with the respondent / Bank on temporary basis. From perusal of Annexure P/5, it appears that in the meeting of Directors of the Bank convened on 20/11/2020, a decision has been taken to increase the remuneration of the District Education Officer working in the bank on temporary basis. This letter further reflects that a request was made by the union of the computer

operators working in the respondent / bank to increase the remuneration to Rs.18,420/- in the light of Finance Instructions dated 02/08/2023 upon which a letter was sent seeking approval for enhancement of remuneration of Date Entry Operators working on temporary basis in the bank to Rs.18,420/- per month. It appears that no decision has been taken by the State Government. Therefore, at this stage, this writ petition is disposed off. It is expected that respondent No.2 shall taken decision on the letters dated 27/09/2021 (Annexure P/5) and 29/01/2022 (Annexure P/6) expeditiously with a period of 120 days from the date of receipt of copy of this order. This Court has not expressed any opinion on the merits of the case. If any adverse order is passed, the petitioner may again approach this Court.
