would further submit that WPS No. 3108 of 2005 was filed before this Court and the same was allowed in part on 28.07.2006 whereby the services of the petitioner were regularized along with 50% back-wages. He would also submit that on 07.02.2007 the petitioner was reinstated and vide order dated 15.11.2010 the petitioner was directed to pay an amount of Rs.81,968/- to the department. He would further contend that the amount so demanded was deposited by the petitioner on 16.11.2010 and thereafter, the petitioner was transferred from the State of Madhya Pradesh to the State of Chhattisgarh on 14.01.2011. He would also contend that a representation was made before the authorities to reckon the period of termination treating him in service. He would further argue that vide letter dated 15.11.2010, the Superintendent of Police has stated that in the absence of any order / direction issued by the State, no decision can be taken on this issue.
