Learned counsel for the petitioner would submit that the petitioner was working as a daily wages employee under respondents No. 2 to 4 since 01.05.1988 whereas respondent No. 5 was also working as a daily wages employee since 01.09.1988. He would further submit that vide order dated 22.01.2008, the petitioner, as well as respondent No. 5, were appointed to the post of Messenger in District Union at Dharamjaigarh and Kawardha, respectively. He would refer to the gradation list where the name of the petitioner was placed above respondent No. 5. He would also submit that in this manner, respondent No. 5 was promoted to the post of Assistant Grade-III vide order dated 14.07.2008 and when the seniority list was published, the petitioner came to know that respondent No. 5 has been promoted to the post of Assistant Grade-III whereas qualification of the petitioner and respondent No. 5 were equal and experience was also almost similar. He would lastly submit that the respondent authorities may be directed to consider the seniority of the petitioner from the date of promotion of respondent No. 5 i.e. 14.07.2008.
