It is stated by learned counsel for the petitioner that today some documents regarding pendency of the petition under Section 7 of the

Chhattisgarh Madhyastam Adhikaran Adhiniyam, 1983 before the Arbitration Tribunal has been filed by submission memo, the same may be taken on record.

Learned counsel for the petitioner submits that the present petition has been filed questioning the order dated 25/02/2016 issued by the respondent seeking encashment of renewed FDR No.085571 for Rs.16,96,000/- issued by Vijaya Bank at the instance of petitioner in favour of the respondent towards EMD in relation to Package No. MMDMT-01 to 06 (Annexure-P/1). He further submits that on 09/03/2016 this Court has passed an interim order directing that the FDR of the petitioner shall not be encashed and said interim order dated 09/03/2016 is still in operation.

As the issue in this writ petition is also sub-judice before the Arbitration Tribunal where the petitioner has preferred a petition under Section 7 of the Chhattisgarh Madhyastam Adhikaran Adhiniyam, 1983 and the said proceeding is likely to be concluded within four months, the present petition can be disposed off with a direction for early disposal of the proceeding before the Arbitration Tribunal.

Learned counsel appearing for the State submits that he has no objection if the writ petition can be disposed off with a direction to the Tribunal for early disposal of the proceeding pending before the Tribunal.

In view of the above submission made by learned counsel for the parties, the writ petition is disposed off with a direction to the Tribunal to conclude the proceeding pending under Section 7 of the Chhattisgarh Madhyastam Adhikaran Adhiniyam, 1983 within a period of five

months, the interim order granted by this Court on 09/03/2016 will be continued till the disposal of the proceeding pending before the Arbitration Tribunal.

The writ petition is disposed off accordingly.
