By the present writ petition the petitioner is seeking a direction to the respondent No. 1/Collector, Raigarh to consider and decide the application of the petitioner for grant of permanent lease of the land situated in Jailpara, Raigarh Sheet No. 60, Plot No. 34, measuring 2750 sq. ft.

the State submits that the petition may be disposed off with a direction to the respondent-State to issue the permanent lease on the condition/land revenue assessed by the respondent Nazul Officer, Raigarh, which is reflecting from the order Annexure-R/1 that for the period from 01/04/2005 to 31/03/2022 total 17 years the land revenue amounting to Rs.2,93,148/-.

From perusal of the Annexure-R/1 dated 19/12/2016 issued by the Nazul Officer, Raigarh it appears that the Nazul Officer has proposed that the petitioner would be given permanent lease for the commercial purpose, hence the petitioner is required to deposit the land revenue to the tune of Rs.2,93,148/- for the period from 01/04/2005 to 31/03/2022.

Learned counsel appearing for the State submits that she has no objection if the petitioner by complying with the condition enumerated in Annexure-R/1 dated 19/12/2016 applied for permanent lease, the same shall be considered and permanent lease will be issued in terms of reply of the State paragraph 5 & 6.

Hence, the writ petition is disposed off with a direction to the Collector, Raigarh to take necessary steps for issuance of permanent lease for the land situated in Jailpara, Raigarh (C.G.) Sheet No. 60, Plot No. 34, measuring 2750 sq. ft., if the petitioner fulfill the condition enumerated in Annexure-R/1 dated 19/12/2016.
