1. Learned counsel for the petitioners would submit that a letter issued by The Executive Engineer, Water Resources Department, Rajnandgaon on 28.03.2024 according to which, lands of the petitioners are not going to be affected on account of construction of canal. Thus, in the light of letter dated 28.03.2024, petitioners seek permission of this Court to withdraw this petition. However, he would submit that petitioners may be granted liberty to file a fresh petition if cause of action subsists.

4. Taking into consideration the submission advanced by learned counsel for the petitioners, present writ petition is dismissed as withdrawn with liberty to file a fresh petition if the cause of action still subsists. Copy of the letter dated 28.03.2024 is taken on record.
