1. The petitioner has filed this petition seeking the following relief(s):-

“ 10.1 That the Hon’ble Court may kindly be pleased to set aside and quashed the impugned order dated 11.10.2021 as well as 22.09.2021 passed by respondent No.1 and respondent No.2 respectively.

10.2 That, Hon’ble Court may remove the private respondent No.3 from his post on the ground of Section 40 of the Panchayat Raj Adhiniyam.

10.3 Any other relief as deemed fit by this Hon’ble Court may also be granted in favour of the petitioner.”

2. Learned counsels appearing for the respondents would submit that

in a proceeding, the Sub-Divisional Officer (Revenue), Janjgir, District-Janjgir Champa (C.G.) passed an order dated 23.07.2021 and the same was affirmed by the Collector vide order dated 11.10.2021. They would further submit that the order is revisable before the Commissioner according to the provisions of Rule 5 of the Chhattisgarh Panchayats (Appeal and Revision) Rules, 1995.

At this stage, learned counsel appearing for the petitioner would seek permission from this Court to withdraw the present petition with the liberty to file a duly constituted revision before the authority concerned. He would also pray that the authority may be directed to decide the revision to be preferred by the petitioner within a stipulated period.

4. No objection from the other side.

5. Permission is granted.

The present petition is disposed of with liberty to the petitioner that if the petitioner prefers a revision before the Commissioner (Division) Bilaspur (C.G.) within a period of 10 days, the Revisional Authority i.e. the Commissioner (Division) Bilaspur shall decide the revision preferred by the petitioner preferably within a period of 90 days from the date of its presentation.
