After arguing for some time, when a query was put as to whether service has been properly effected on Defendant No.4, Shri Bhadoriya submits that the said Defendant has refused to accept the same. He, however, fairly admits that the procedure under Order 5 Rules 17, 18 & 19 CPC has not been complied with and therefore, he does not want to press this Petition and prays for issuance of a direction to the concerned Court below to decide the main Civil Suit in an expeditious manner. He further prays that the cost which has earlier not been accepted by the Petitioner may be directed to be paid by the Defendant.

Accordingly, it is directed that the concerned Court below shall decide the main Civil Suit in an expeditious manner and the Defendant shall pay the cost to the Petitioner through his Counsel within a period of 30 days after passing of this order.

This Court hopes and trusts that the concerned Court below shall proceed in the matter in accordance with law expeditiously.
