The applicant has preferred the first bail applications under Section 483 of Bhartiya Nagrik Suraksha Sanchita, 2023 for grant of regular bail as he is in jail since 15.01.2022 in connection with Crime No.14/2022 registered at Police StationKotwali Jagdalpur, District Bastar (C.G.) for the offence punishable under Sections 409, 420, 120B of IPC and Section 66 (c) of IT Act.

The prosecution story, in brief, is that the complainant, a manager of CMS Infro System who works for depositing the money at the ATMs in all over Chhattisgarh, lodged a report alleging that custodians of his company Yogesh Yadav and Kaushal Yadav were directed to deposit the cash at ATMs of SBI Main Branch and Collectorate Branch, Jagdalpur. In the audit report, it was revealed that cash of Rs.3,66,77,000/- was not deposited in 19 ATMs. On such complaint, FIR was registered against the co-accused persons and present applicant.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. The main allegation is against the coaccused Yogesh Yadav who has already been granted bail by this Court vide order dated 22.07.2024 in MCRC No.5145/2024. He further submits that the applicant is in jail since 15.01.2022 and trial may take some time in its conclusion. Therefore, the present applicant may kindly be released on bail.

On the other hand, learned State counsel opposes the bail application.

I have heard learned counsel for the parties and perused the case diary.

Having considered the facts and circumstances of the case, nature of allegation, for the fact that the co-accused has been granted bail by this Court, applicant is in jail since 15.01.2022 and the trial is likely to take some time in its conclusion, without commenting anything on the merits of the case, this Court is of the view that it is a fit case to release the applicant on regular bail.

Accordingly, the bail application filed by applicant is allowed and it is directed that applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with one solvent surety for the like amount to the satisfaction of the

concerned trial Court. He shall appear before the trial Court on each and every date given by the said trial Court, till disposal of the trial.

It is made clear that the observations made hereinabove is only for the purpose of deciding the bail application and the trial Court will decide the case on its own merit without being influenced by any observation made hereinabove. It is also made clear that the trial Court is at liberty to cancel the bail application of the applicant in the event of applicant involving himself in similar offence in future and violate any of

the conditions.
