This is 3^rd bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the Applicant, who has been arrested in connection with Crime No.413/2022 registered at P.S Chhawni, District Durg (CG) for the offence under Section 420/34 IPC. The 2^nd application was rejected vide order dated 19.02.2024

passed in M.Cr.C No.111/2024 and the 1^st was dismissed as withdrawn on 28.06.2023 vide M.Cr.C No.2829/2023.

Case of the prosecution is that the present Applicant along with co-accused namely Nutan Kumar Chauhan, has cheated various persons on the pretext of providing them with the jobs and obtained money to the tune of Rs.34,00,000/- in a fraudulent manner, therefore, the aforesaid offence has been registered against him.

Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the crime in question for which, he was arrested on 15.12.2022. He further submits that earlier, this Court has directed for expeditious trial but yet the same has not been concluded and the offence is triable by the JMFC, therefore, the Applicant may be released on bail.

On the other hand, learned counsel for the Non-Applicant/State opposed the bail application and fairly admitted that there are no previous criminal antecedents against the present Applicant.

Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, considering the nature of the case and the pre-trial detention, without further commenting anything on merits, I am inclined to allow the application.

Accordingly, the application is allowed and it is directed that on Applicant’s furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, he shall

be released on bail. He shall however, make his appearance before the

concerned Court as and when so directed.
