The applicant has preferred this First Bail Application under Section 439 of Cr.P.C. for grant of regular bail, as he has been arrested in connection with Crime No. 06/2024, registered at Police Station, Excise Circle Kota, District – Bilaspur (C.G.) for the offence punishable under Section 34(1)(A), 34(2) and 59(A) of the C.G. Excise Act.

The case of the prosecution, in brief, is that on 22.04.2024, the Police of Police Station Excise Circle Kota, District – Bilaspur (C.G.) has received a secret information through the informant and on the basis of such information, raid was conducted and the police has seized

total of 40 bulk liters of hand made mahua liquor from the possession of the present applicant near the house of the applicant. Thereafter, the Police arrested the present applicant and the crime was registered.

It is argued by the learned counsel for the applicant that the present applicant is innocent and is falsely implicated in this case, and the aforesaid liquor has not been seized from the possession of the present applicant. He further submits that there is no criminal antecedents of the applicant and the charge-sheet has been filed in this case. He further submits that under Section 34(2) of the Excise Act, minimum punishment is one year and maximum punishment is three years and the applicant is in jail since 22.04.2024, the trial is likely to take some time for its conclusion, therefore, he prays grant of bail.

On the other hand, the learned counsel for the State opposes the bail application but admits that the the applicant has no criminal antecedents and the charge-sheet has been filed in this case. It is also submitted that 40 bulk liters of hand made mahua liquor was recovered from the possession of the applicant, therefore, he is not entitled for grant of bail.

I have heard learned counsel appearing for the parties and perused all of the documents available on record.

Taking into consideration the facts and circumstances of the case, nature and gravity of allegations levelled against the applicant and the fact that the applicant has no previous antecedents, charge-sheet has been filed against the applicant and he is in jail since 22.04.2024 and

conclusion of the trial is likely to take some time, I am inclined to allow this application.

Let applicant, Pramod Singh Maravi , involved in Crime No. 06/2024, registered at Police Station, Excise Circle Kota, District – Bilaspur (C.G.) for the offence punishable under Section 34(1)(A), 34(2) and 59(A) of the C.G. Excise Act, be released on bail on executing a personal bond in sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance on each date of hearing of the case.
