The appellant has f i led the instant appeal against the judgment and decree dated 01.03.2023 (Annexure-A/1) passed in Civil Suit No. 715-A/2022 by the learned Principal Judge, Family Court Bilaspur, District- Bilaspur (C.G.), whereby the learned Principal Judge Family Court has rejected the appeal for divorce. Hence, the present appeal.

Both the parties are present before this Court today along with their respective counsel.

During the pendency of the appeal, both the parties have settled the dispute outside the court as per settlement/compromise deed dated 26.09.2024 executed before the Notary , which is duly signed by both the parties.

Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicably resolved the dispute outside the Court. As per order dated 27.09.2024, statements of both the parties have been recorded before the Additional Registrar (Judicial) in terms of compromise/settlement deed dated 26.09.2024 and submitted its report before this Court, therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 26.09.2024.

We have heard learned counsel for the respective parties.

In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement/compromise agreement dated 26.09.2024, the present appeal is disposed of in terms of the aforesaid agreement, the terms of the settlement/compromise agreement dated 26.09.2024 will form part of this judgment/decree. It is also pertinent to mention here that the appellant has handed over the Cheque Bearing No. 391286 of State Bank of India dated 26.09.2024 of Rs. 5,00,000/(Five Lakhs Rupees Only) on the same day of agreement to the respondent and also today he has handed over Cheque Bearing No.

391288 of State Bank of India dated 02.12.2024 of Rs. 10,00,000/(Ten Lakhs Rupees Only) to the respondent before this Court after due verif i cation, so the total amount has been paid by the appellant to the respondent for her maintenance i.e. Rs. 15,00,000/- (Fifteen Lakhs Rupees Only). So, this appeal is disposed of in terms of the aforesaid agreement and the marriage between the parties be dissolved from the date of this order.
