The appellant/wife has filed the instant appeal under Section 19(1)

of the Family Courts Act, 1984 against the judgment dated

28/03/2022 passed by the Court of 1 st Additional Principal Judge, Family Court, Raipur, Chhattisgarh in HMA Case No.632/2019, wherein, the learned Family Court has passed the decree of divorce in favour of respondent/husband under Section 13(1) of the Hindu Marriage Act, 1955 and dissolve the marriage solemnized between the parties on 28/04/1991 and granted decree of divorce in favour of respondent/husband.

Both the parties are present before this Court today. The appellant-Smt. Santoshi Bai appeared herself before this Court, who is identified by the respondent-Shiv Kumar Sahu.

During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 16.10.2024, the matter was referred to Mediation Centre of this Court and the parties have settled their dispute before the Mediation Centre on 04.11.2024, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 04.11.2024, which was duly signed by them.

Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicable resolved the dispute before the Mediation Center of this

Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 04.11.2024.

We have heard learned counsel for the respective parties.

In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 04.11.2024, the present appeal is disposed of in terms of the said agreement, the terms of the settlement agreement dated 04.11.2024, will form part of this judgment/decree. It is also pertinent to mention here that the respondent has handed over the bank Demand Draft Bearing No. 240410 of Uco Bank dated 16/11/2024 of Rs. 4,00,000/- (Four Lakhs Rupees Only) to the appellant namely Smt. Santoshi Bai before this Court after due verification.

Let a decree be drawn up accordingly.
