The appellant has filed the instant appeal under Section 19 of the Family Court Act, 1984 against the judgment dated 31.03.2023 passed in MJC No. 04/2021 passed by the learned Principal Judge, Family Court, Baloda Bazar, whereby the learned Family Court while considering the case under Section 19 of Hindu Adoption and Maintenance Act, 1956 has granted maintenance amount

of Rs. 9,000/- to the respondent and his mother, which shall be paid by the appellant.

Both the parties are present before this Court today.

During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 14.10.2024, the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre on 06.11.2024, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 05.11.2024, which was duly signed by them.

Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicable resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 05.11.2024.

We have heard learned counsel for the respective parties.

In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 05.11.2024, the present appeal is disposed of in terms of the said agreement, the terms of the settlement agreement dated 05.11.2024, will form part of this judgment/decree . It is also pertinent to mention here that the appellant has handed over the bank Demand Draft Bearing No. 370324 of Union Bank of India dated 30.10.2024 of Rs. 3,00,000/- (Three Lakhs Rupees Only) to the guardian of respondent namely Shri Avinash Giri Goswami before this Court after due verification.

Let a decree be drawn up accordingly.

Interlocutory application, if any pending, shall also stand disposed of.
