submitting written complaint (Ex.P/03) stating therein that on 17.05.2018 while her daughter (PW-01) was alone, the appellant herein illegally entered into her house and outraged the modesty of the victim (PW-01), pursuant to which, FIR (Ex.P/04) was registered by the police against the appellant for offences under Section 452, 354, 506 of IPC and also under Section 08 of the POCSO Act, 2012. Thereafter, on the same day, after two hours, father of the victim (PW-05) submitted another written complaint (Ex.P/10) alleging commission of rape with her daughter (PW-01) by the appellant and, accordingly, wheels of investigation started running, in which, spot map was prepared vide Ex.P/24. After obtaining necessary consent vide Ex.P/01, the victim (PW-01) was subjected to medical examination on 26.05.2018, which was conducted by Dr. Okeshwari Sahu (PW-04) and, as per her MLC report Ex.P/09, it has been opined that according to clinical features, sexual contact with the victim (PW-01) has taken place, however, confirm opinion will be given after chemical analysis of victim’s clothes, hair, vaginal slides. Further, victim’s pubic hair, vaginal slides, and clothes (undergarment) were taken and handed-over to the police, which were seized vide Ex.P/13 on 26.05.2018. The accused-appellant was arrested vide Ex.P/17 and sent for medical examination. Appellant’s MLC report is Ex.P/11 and further his slides were prepared and handed-over to the police alongwith his undergarment for analysis, which were seized vide Ex.P/16 on 26.05.2018.
