Case of the prosecution, in brief, is that the complainant/appellant Tulsingh Sonwani has lodged a written report to the police with the allegation that on 24-01-2021, when he was returning to his house in the evening, he saw the cattle of the accused Chamar Singh was grazing his crop in the field. He had gone to the house of the accused Chamar Singh to convince him to keep his cattle in cattle shed. At that time, the respondent no. 3/accused Jailal has enraged with him and shown his protest. The respondent no. 2/accused had took out a lathi from his house and about to assault upon the complainant but he was caught by the witnesses and snatched the lathi from him. The respondent no. 2/accused had not stopped and continued in altercation with the complainant. The incident was witnesses by Dukhuram Sonwani, Savita Sonwani, Savitri Sonwani, Padman and Jugeram Nagesh. On the basis of written complaint, the FIR Ex. P-2 was registered for the ofence under Section 294, 506, 34 of IPC. After recording statements under Section 161 of Cr.P.C. and completion of usual investigation, the charge sheet was filed against the respondents no. 2 and 3/accused persons, before the learned trial court for the offences under Section 294, 506, 34 of IPC and Section 3(1)(r) and 3(1)(s) of the SC/ST Act.
