petitioner was already examined by the Management in the year 1995 vide order dated 06/07.06.1995, thereby the date of birth of the petitioner was confirmed as 06.11.1947 in service sheet and Form-B, but the petitioner again made a representation before the Competent Authority for correction of date of birth, upon which vide letter dated 25.11.1998, the DGM, Kusmunda Project informed the petitioner that his case has already been examined by the Age Determination Committee and the decision of the said Committee was conveyed to the petitioner vide letter dated 15.06.1995, as such the case cannot be reopened. The petitioner has not challenged the order of the Age Determination Committee and instead he filed the earlier writ petition in the year 2007 after lapse of 14 years and thereafter the instant petition has been filed, therefore, the present petition is not maintainable on the ground of delay and laches. He next submits that it is well settled position of law that for correcting the date of birth, there has to be conclusive proof of the date of the birth and that the proof should be genuine, but the same is missing in the instant case, as such there is no scope of judicial review/judicial scrutiny. Accordingly, the petition deserves to be dismissed.
