to sell of aforesaid land dated 31-7-2015 was also executed between the petitioner and respondent No. 3, bond for aforesaid invested amount were also issued by respondent No. 3 in favour of the petitioner. Subsequently, some investors made complaint to the Superintendent of Police, Durg, who took action under the provisions of CG Protection of Depositors Interest Act, 2005 (henceforth, referred to as ‘the Act of 2005’), and case was registered as Case No. 51/B-121/year 2015-16 before the Court of District Magistrate, Durg who in turn vide order dated 23-4-2016 attached the property provisionally under Section 7(1)(ii) of the Act of 2005 and thereafter the said provisional attachment was made absolute by the Special Court, Durg under Section 8 of the Act of 2005. It is further submitted that the petitioner has paid entire amount of house/property and he was also given possession, therefore, he is entitled to get property under the provisions of Section 54 of the Transfer of Property Act, 1882. It is also submitted that the respondent authorities are going to sell the property in question, through auction, which is part of other properties of respondent No. 3, hence protection as prayed for by the petitioner may be granted.
