Learned counsel for the petitioners would submit that the petitioners were granted Patta on Aabadi Bhoomi bearing plot No.28 & 29 situated at village Jhofara, Kilepar – 2, Gram Panchayat Dongitarai, Tahsil Gunderdehi, Distt. Balod by the Gram Panchayat, Dongitarai on 12.7.2005 with a condition that house be constructed on that land. After allotment of the land, it was found that the aforesaid land situates in the premises of school boundary, therefore, the petitioners could not construct their houses in Plot No.28 & 29. He would further submit that despite application (Annexure-P/3) given to the Gram Panchayat, Dongitarai for exchange of plot and it was prayed that instead of Plot No.28 & 29, plot No.50 & 51 be allotted to them and Patta be granted to them in this regard. He would further submit that despite various representation given to the concerned Gram Panchayat, no heed has been given to the same. He would further submit that Tahsildar Gunderdehi, Distt. Balod has also passed order dated 16.6.2022 (Annexure-P/6) in this regard, despite that order, Sarpanch of Dongitarai (respondent No.4) has not issued Patta in the name of the petitioners. Learned counsel for the petitioners would further submit that the petitioners are ready to file fresh representations for redressal of their grievances to the Collector and therefore, this petition may be disposed of by directing the Collector Balod, Distt. Balod to consider and decide the representations of the petitioners, within a stipulated period.
