1. This writ petition has been filed against order dated 30.12.2022 (Annexure-P/1), passed by the respondent No.02 for removal of encroachment and First Information Letter (Annexure-P/2) issued by the respondent No.05.

2. Learned counsel for the petitioner submits that the petitioner will file reply/representation to the aforesaid order (Annexure-P/1) and letter (Annexure-P/2) and same shall be directed to be decided afresh by the respondent/competent authority within reasonable time.

3. Be that as it may, the petitioner is allowed to prefer said reply/representation against the impugned order (Annexure-P/1) and letter (Annexure-P/2) within three weeks from today and, in turn, the respondent No.2/concerned authority shall consider and decide the same on its own

merits in accordance with law by passing a fresh reasoned and speaking order preferably within 03 weeks from the date of submission of such reply/representation alongwith copy of this order. Further, for a period of eight weeks, the interim order dated 19.01.2023, passed by this Court shall remain in operation.

4. With aforesaid observation and directions and without expressing any opinion on the merits of the case, the writ petition stands disposed of.
