the second marriage with another lady, owing to which, she started residing in her parental house. It is pleaded further that her father and mother both have died and therefore, she has been constrained to live with her sister as she has no independent source of income for her livelihood. Further contention of her is that on 24.06.2021, she filed an application under Section 125 of the Cr.P.C. before the Family Court, Kabirdham, where it has been registered as Miscellaneous Criminal Case No.51/2021 and during the pendency of the said proceeding, the respondent/husband has initiated the proceedings under Section 13 of the Hindu Marriage Act, 1955(hereinafter referred to as the ‘Act of 1955’) seeking dissolution of the marriage before the Principal Judge, Family Court at Durg. It is pleaded further that her husband and in-laws are residing at Durg and several times, they threatened her and therefore, she is not safe to visit to Durg alone as there is no male member in her family. It is contended further that her parents have passed away and she is residing with her sister without any independent source of income and therefore, it is difficult for her to attend each and every date of hearing before the said Court i.e. Principal Judge, Family Court, Durg, which is 130 KM away from her residence. With this plea, the petitioner is praying for transfer of Civil Suit No.411/2022 pending before the Principal Judge, Family Court, Durg to the Family Court at Kabirdham.
