applicant has contacted them to continue work of handling and commission agent with them accordingly, she was appointed as handling and commission agent to sell the product manufactured by them with 4% commission on net sales or 1800 per tonne whichever is less is payable to her. The rate fixed between them is inclusive of all the expenditures of handling and commission such as storage, loading and unloading, office expenses. The complainant is sending the material to the accused since 2012 and thereafter they are sending the bills which were payable to them. The applicant has sent statement of account of stocks till the month October 2022, thereafter the applicant has stopped the same. It is also the case of the prosecution that as per the record available with them 128.075 metric tonne material is stored with the applicant. Since they have not sent the statement of stock, thereafter the complainant has sent one officer of the company to investigate the matter but the accused has not shown the stock. The complainant has made an attempt to contact the accused but no contact was established thus the complainant apprehends that the accused has committed offence under Section 407 IPC by committing criminal breach of trust in respect of the property which is valued at Rs. 89, 73,320/-.
