20.5.2022 to 14.6.2022 transferred Rs.16,40,000/- by way of RTGS by forging the signature of Managing Director and Accounts Officer of Mandi Board in the account of co-accused persons in various States. It is also alleged that cheque book in this regard was also obtained fraudulently by the accused persons. Case of the prosecution is that pursuant to the role played by the applicant, he was given Rs.80 lakh in cash which has been stated by one of the main accused Sourabh Mishra in his memorandum statement and Rs.58,95,000/- allegedly been seized from the present applicant Gulam Mustafa from his house. 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in this case. As per the prosecution story, the applicant introduced Sandeep Ranjan Das, Branch Manager of Axis Bank to Bhuvnesh Yadav, Managing Director of Mandi Board. Till date 09 material witnesses have been examined out of 47, including Managing Director of Mandi Board Bhuvnesh Yadav (PW-5), B. Anand Rao (PW-1) and Accounts Officer Kailash Chandra Sharma (PW-3), but they have not named the applicant in respect of alleged role or any role played by him in commission of instant crime. It is further submitted that the applicant was the Branch Manager of Kotak Mahindra Bank, but no amount has been deposited in his bank. It is further submitted that the applicant has been implicated only on the basis of memorandum statement of accused Sourabh Mishra and the alleged amount, i.e. Rs.58,95,000/- seized from his house. But that amount was given by the builders, namely Dinesh Kumar Yadu and Ishwar Das, pursuant to agreement of sale with them by Gulam Jilani, who is elder brother of present applicant, to sell their family property situated at Sadar Bazar, Raipur as part of the sale consideration, which was kept in the house of the applicant and the same was shown to be seized from him. In this regard learned counsel for the applicant draw the attention of the Court to the agreement of sale executed between Gulam Jilani as first party and Dinesh Kumar Yadu and Ishwar Das as second party.
