Applicant has preferred this First bail application under Section 439 of the CrPC for grant of regular bail as he is arrested in connection with Crime No.105 of 2022, registered at Police Station- Mujgahan, district- Raipur (CG) for the offence punishable under Sections 419, 420, 409, 467, 468, 471, 120-B, and 34 of the IPC.

Case of the prosecution in brief, is that complainant has lodged report to the concerned Police Station that present applicant along with other coaccused persons, committed fraud by transferring money using account No.922010025774139, which belongs to CG State Agriculture Marketing (Mandi) Board, Raipur. On the basis of complaint, FIR has been registered against the applicant and other co-accused persons.

Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the case. He further submits that main accused has already been released on bail by the Court below and other co-accused persons have already been granted bail by this Court vide order dated

28.07.2023 passed in MCRC-10980, 10940 and 5285 of 2023. Applicant is in jail since 24.11.2022. Charge-sheet has been filed and there is no likelihood of his case being decided in near future, therefore, he may be released on bail.

On the other hand, learned counsel for the State though opposed bail application, submitted that other co-accused persons including the main accused person, have already been granted regular bail by this Court.

Heard learned counsel for the parties and perused the case diary.

Considering facts and circumstances of the case, and further considering the fact that main accused and other co-accused persons have already been granted bail, looking to the detention period of the applicant, and the trial may take some time, without further commenting on merits of the case, I am inclined to release the applicant on bail.

Accordingly, bail application is allowed.

It is directed that applicant shall be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two local sureties of the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed.
