This is the 1^st bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the Applicant, who has been arrested in connection with Crime No.361/2020 registered at P.S Supela, District Durg (CG) for the offence under Sections 419, 420, 467, 468, 471 and 120B IPC.

Prosecution case is that the present Applicant had prepared false seals in the name of patwari and naib tahsildar etc without due permission of the concerned officers with which, he committed fraud and forgery, therefore, the offence as aforesaid has been registered against the present Applicant.

Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the crime in question for which, he is in jail since 28.06.2022. He further submits that in the

similar nature of offence, the present Applicant had already been enlarged on bail and in one of the similar cases, the present Applicant and other co-accused have already been acquitted in Criminal Case No.2672/2020 by the Court of JMFC, Raipur vide judgment dated 24.02.2023 copy of which, has been annexed herewith, conclusion of trial is likely to take quite some time, therefore, considering all these aspects, the present Applicant may be released on bail.

On the other hand, learned State Counsel opposed the bail application.

Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, considering that the Applicant had already been released on bail in a similar nature of offence in other cases, further considering the pre-trial detention and conclusion of trial may take some time, without further commenting anything on merits, I am inclined to allow the application.

Accordingly, the application is allowed and it is directed that on Applicant’s furnishing a personal bond for a sum of Rs.50,000/- with two sureties in the like sum to the satisfaction of the concerned Court, he shall be released on bail. He shall however, make his appearance before the concerned Court as and when so directed.
