This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.1327/2022 registered at Police Station Durg District Durg (CG) for the offence under Sections 294, 324, 326, 506 of the IPC.

Prosecution case, in brief is that on 10.11.2022, in the evening, the applicant came to the shop of injured - Lalita Sahu and borrowed some snacks, on which, some quarrel took place. In the said quarrel, the present applicant threw the hot oil in pan, which was kept nearby in the hotel, on the body of the injured and caused burn injury to her. Based on such allegation, the offence has been registered.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. He submits that the incident took place suddenly and the applicant was having no intention to harm the injured. He further submits that the applicant has no criminal past and further, he is a young man aged about 22 years, who is in jail since 12.11.2022. Hence, learned counsel prays for releasing the applicant on bail.

On the other hand, learned counsel for the State opposes the bail application. However, she submits that there is no criminal antecedent of the applicant.

Having considered the submissions of learned counsel for the parties, particularly considering the nature of accusation and also considering the age of the applicant and his pre-trial detention, this Court is inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
