This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.20/2023 registered at Police Station PS Podi, District M.C.B. (CG) for the offence under Sections 363, 366, 376 (2)n of the IPC with Sections 6 & 17 of the POCSO Act.

Case of the prosecution, in brief, is that father of prosecutrix lodged a report on 26.1.2023 alleging that the applicant, on the pretext of marriage, committed repeated sexual intercourse with the prosecutrix. Hence, the aforesaid offence has been registered.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. The applicant is in jail since 2.2.2023. Hence, he prays for releasing the applicant on

bail.

On the other hand, learned counsel for the State opposes the bail application.

On 4.4.2023, the father of the prosecutrix appeared through the video conferencing from the concerned DLSA and strongly objected to grant of bail to the applicant.

Having heard the submissions of learned counsel for the parties, particularly considering the statement of the prosecutrix and further considering the pre-trial detention of the applicant, without commenting anything on the merits of the case, I am inclined to release the applicant on bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with two sureties in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
