This is first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 26-1-2023 in connection with Crime No. 82/2023 registered at Supela, Distt. Durg (C.G.), for the offence punishable under Sections 34(2) of the Chhattisgarh Excise Act.

Prosecution story, in brief, is that on 26-1-2023, 151.200 bulk liter of country liquor has been seized from the illegal possession of the applicant.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He further submits that the applicant is in jail since 26-1-2023, charge sheet has been filed, hence, the applicant may be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application and submits that earlier 4 cases of like nature have been registered against the applicant, therefore, he is not entitled for grant of bail.

In reply, learned counsel for the applicant submits that out of 4 cases, 3 cases have already been disposed of and only fine has

been imposed, he has filed documents in this regard. Only one case is pending.

I have heard learned counsel for the parties, perused the case diary and the material available on record.

Considering the facts and circumstances of the case, applicant’s detention period and as charge sheet has been filed, I feel inclined to grant bail to the applicant. Therefore, the application under Section 439 of the CrPC is allowed. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with two sureties each of like sum to the satisfaction of the concerned trial Court for his appearance before the concerned Court as and when directed by the said court, he be released on bail.
