In the course of trial, since the victim had given birth to a baby on 18.1.2015, therefore, allowing the application of the prosecution, the DNA Profiling Test of the appellant, the victim and the baby was conducted on 23.4.2015 vide Exhibit P-20, proved by Dr. Devendra Kumar (PW-11), in which the appellant has been shown to be the biological father of that baby. Statement of the accused/appellant was recorded under Section 313 of CrPC in which he denied circumstances appearing against him in the evidence brought on record by the prosecution, pleaded innocence and false implication. 5. After conclusion of the trial, the Trial Court, by impugned judgment dated 17.12.2015, on appreciation of the oral and documentary evidence available on record, while acquitting the appellant from the offence punishable under Section 506 (Part-II) of IPC, has convicted him under Section 376(2)(i)(n) of IPC, Section 5/6 of the POCSO Act and Sections 3(2)(v) & 3(1)(xii) of the SC/ST Act and sentenced him in the manner as mentioned in the opening paragraph of this judgment, against which
