Teklu @ Bhagwati Yadav, by which, he fell down and died. Three appellants have also said to have caused simple injury to Uderam (PW-1) and on the report of Uderam (PW-1), merg intimation was registered vide Ex.P-23, FIR was registered vide Ex.P-24, dehati merg intimation was registered vide Ex.P-25, inquest was conducted vide Ex.P-3 and dead body of deceased Teklu @ Bhagwati Yadav was subjected to post-mortem, which was conducted by Dr. Vinayak Tamrakar (PW-10), who proved the post-mortem report Ex.P-14, in which cause of death was stated to be strangulation and death was homicidal in nature. Pursuant to memorandum statement of appellant No.1 by Ex.P-9, tendu stick and his clothes were seized vide Ex.10 and on the memorandum statement of appellant No.2 by Ex.P-11, tendu stick and his clothes were seized vide Ex.P-12, which were sent for examination to FSL and as per the FSL report Ex.P-34, no blood was found on tendu stick (Article ‘D’) seized from appellant No.1, whereas blood was found on tendu stick (Article ‘G’) seized from appellant No.2 and on the clothes of the deceased, human blood was found.
