co-accused Ramavtar Gupta and S.L. Jagtap were functioning as Assistant Manager (Depot), Mandir Hasaud, F.C.I., Raipur. It is also not in dispute that appellant No.2 Rajkumar Damani was awarded and appointed as an H&T Contractor for loading/unloading/transporting of food grains, sugar, groundnut and other materials in and around the centres for a period of two years w.e.f. 13.03.1987 to 18.03.1989. It is also not in dispute that absconded accused Pradeep Kumar Pandey was a representative of appellant No.2. Chandra Lal Rajak (PW-5) and one Ganesh Sahu were also working in the F.C.I. as representatives of appellant No.2 during the relevant period. Statements of T.I. Rebello (PW-1), who inquired into the matter, J.P. Hadia (PW-3), Assistant Grade-II of the concerned Depot of the F.C.I., C.L. Gotia (PW-4), Assistant Grade-I of concerned Depot of the F.C.I., L.L.Gulhare (PW-6), Assistant Grade-I of the Depot of the F.C.I., S.N. Bachher (PW-7), Assistant Grade-III of the Depot of the F.C.I., clearly show that Pradeep Kumar Pandey, Chandra Lal Rajak (PW-5) and Ganesh Sahu were working as the representatives of appellant No.2. From the statements of the above witnesses, it also reveals that whatever work was completed by the contractor, a work slip therefor in three copies was issued by the godown incharge. That work slip contained the details of the work completed both in words and fgures. Out of the three copies of the said slip, one copy was issued to the contractor and the other one copy was sent to the Central Depot Ofce and remaining one copy was left in the slip book for ofce use. The contractor used to raise his bills on the basis of the work slip issued to him and after necessary verifcation his bills were passed. The deceased accused/appellant No.1 was entrusted with the work of said verifcation and passing of the bills.
