This contempt petition is filed alleging willful disobedience of the order dated 18.06.2012 passed in WPC No.4304 of 2010.

Learned counsel for the respondent submits that respondents

have written several letters to the petitioner to grant access of account of petitioner for purpose of audit so as to release the financial assistance for which petitioner is entitled, however, petitioner has not permitted to excess his account, therefore, the claim of petitioner with respect to financial assistance is not disbursed. He submits that in the event the petitioner shows its account to Audit Team, after auditing account of the petitioner by the Audit Team, immediately thereafter the financial assistance for which petitioner becomes entitles will be released.

Submission of learned counsel for the respondent is disputed by learned counsel for the petitioner on the ground that document which was filed along with earlier reply shows some dispute with regard to account of 2010-11 onwards and there was no letter/request for auditing the account since 1998-1999 to 20092010.

Considering the submission of learned counsel for the respective parties, in particular submission of learned counsel for respondent based on letter dated 27.02.2013 and 14.03.2013 asking the petitioner to provide account for verification/audit to proceed the claim of petitioner for disbursement of the financial assistance, which was not done by the petitioner, this contempt petition at this stage is disposed of reserving liberty with the petitioner to produce the account before the Audit Team of the respondent for inspection/verification/audit and after the submission of report by the Audit/Inspection/Verification Team with respect to account of

the petitioner, respondent authority shall disburse the financial assistance to petitioner within a further period of 4 weeks thereafter for which he becomes entitle.

As submitted by learned counsel for the petitioner, let the Team for verification/audit of the account of petitioner visit the office of the petitioner on 22^nd November 2023 .
