at the time of incident went to another village to irrigate his field. Their children were also not present. When the victim raised an alarm, Nohar Singh, PW-2, came to her house and protected the victim. The accused is said to have assaulted Nohar Singh. Thereafter, one Punitram came and protected the victim and Nohar Singh from the accused. It is alleged that the accused thereafter went to the police station along with his father, who happens to be Village Kotwar, and lodged a false FIR against Nohar Singh, PW-2. On 12.10.2006 when the Husband of the victim returned to him home from another village, the victim narrated the incident. On 13.10.2006 and 16.10.2006 the victim tried to lodge an FIR but the Police refused to lodge the same and no action was taken. Finally, the complaint was filed on 29.11.2006 before the Judicial Magistrate First Class, Bemetara, which was registered against the respondent-accused and subsequently on being noticed, the accused appeared and case was tried by the Trial Court. During the course of trial, charges were framed under Section 354 IPC, read over and explained to the accused who abjured his guilt.
