Police Establishment, Lokayukt Office, Bastar Division, Jagdalpur to the effect that the accused demanded Rs.5000/- from the complainant for appointment of his brother Lachhanram Nag on the post of Cook. On 26.10.1999 the complainant gave Rs.3000/- and on 10.1.2000 gave Rs.1000/- to the accused for appointment of his brother on the said post. He stated that his brother Lachhanram Nag was appointed as Cook in Village Binjhe Ashram on 27.10.1999 at the rate of Rs.1556/per month but since then did not receive any salary. On 10.1.2000 when the complainant discussed about the above matter with the accused, he demanded remaining amount of Rs.1000/- from the complainant. On the said complaint, the Superintendent of Police constituted a trap team, conversation of the accused and the complainant was recorded and transcription of the same was made. The complainant and the witnesses were made aware of the trap proceedings. Thereafter, the complainant went to the office of the accused and after some time came out and gave signal to the trap team. Thereupon, the members of the trap team entered the office of the accused, gave their introduction to the accused and enquired about the bribe amount. On this, the accused informed them about the bribe amount being kept in the left pocket of his shirt. After completing the usual formalities, charge sheet under Sections 7, 13(1)(d) read with Section 13(2) of Prevention of Corruption Act was filed against the accused on 31.6.2000.
