Heard Mr. Rajeev Shrivastava, learned senior counsel for the petitioners. Also heard Mr. Jitendra Pali, learned Deputy Advocate General, appearing for respondents No.1 & 3, Mr. Ramakant Mishra,

learned Assistant Solicitor General, appearing for respondents No.2 & 4 as well as Ms. Hina Animesh Netam, respondent No.5, who has appeared in person.

The writ petition was filed against an order dated 22.10.2021 passed by the Central Administrative Tribunal, Jabalpur Bench (in short, ‘CAT’) in M.A. No.387/2021, arising out of Original Application No.138 of 2021, by which interim order was passed in favour of respondent No.5.

This Court, by an order dated 21.01.2022, while issuing notices, had suspended the order dated 22.10.2021 until further orders.

Respondent No.5 has filed an application for vacating the order dated 21.01.2022.

It is noticed that the interim order was passed in presence of learned counsel, appearing for respondent No.5.

Ms. Netam has submitted that as the original application is pending before the learned CAT, this Court may dispose of the present writ petition with a direction to the learned CAT to dispose of the original application filed by her within the time frame as may be considered appropriate. She has submitted that the pleadings are complete before the learned CAT.

Mr. Shrivastava does not have any objection to the prayer made by Ms. Netam.

No objection is also put forward by Mr. Pali and Mr. Mishra.

In view of above, we dispose of the present writ petition as follows :

(i) The parties to the proceedings will appear before the learned CAT on 16.05.2022.

(ii) The learned CAT will dispose of the original application filed by the applicant / respondent No.5 within a period of one month therefrom.
