Learned counsel for petitioners submits that respondents vide orders dated 04.12.2013 & 22.01.2014 have arbitrarily and illegally withdrawn the benefits which were being earlier granted to petitioners.

Learned State Counsel submits that similar clarificatory order/circular issued by the State Government was put to challenge in batch of writ petitions, which came up for hearing before Co-ordinate Bench of this Court on 17.10.2014 & 26.09.2014 in WPS No.106/2014 & WPS No.1328/2014 and all the writ petitions have been dismissed. In view of aforementioned fact that issue raised by petitioners in this writ petition

has already been considered and decided by Co-ordinate Bench of this

Court, nothing remains in this writ petition for adjudication.

Heard counsel for the parties and perused the records.

¶133

Perusal the pleadings made in writ petition would show that petitioners

have sought for following reliefs :-

“10.1. That this Hon'ble Court may kindly be pleased to set aside/quash the impugned order dated 22.01.2014 (Annexure P-3) & order dated 04.12.2013 (Annexure P-4).

10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent to not to recover the medical allowances house allowances and gatirodh allowances.

10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.”

Co-ordinate Bench of this Court in WPS No.106/2014, along-with batch

of writ petitions, considered prayer for quashment of two circulars/order,

issued by State Government and dismissed the writ petitions by order

dated 26.09.2014, observing as under :-

“49. As a sequel, all the writ petitions, sans substratum , are liable to be and are hereby dismissed with following conclusions :-

Teacher (Panchayat) cadre initially appointed as Assistant Teacher (Panchayat), but later on joined as Teacher (Panchayat) as a fresh recruitee are not entitled for counting their length of service on the lower post for the purpose of revisions of pay scale pursuant to the order dated 17.05.2013 read with the orders dated 4.12.2013 & 22.01.2014.

Teacher (Panchayat) cadre are only entitled for pay scale similar to the Government Teachers.

Teacher (Panchayat) cadre are entitled to Dearness Allowances only, they are not entitled for any other allowances like House Rent Allowances, Medical Stagnation, etc.

The revision of pay scales of Teacher (Panchayat) cadre pursuant to the order dated 17.05.2013 read with the orders dated 4.12.2013 & 22.01.2014 will be on the basis of the pay scale of the post held by them. Such revision is not to

be made on the basis of Kramonnati Vetanman or Samayman Vetanman.

Recovery of excess amount paid to the Teacher (Panchayat) on account of wrong fixation of pay scale or wrong payment of allowances does not suffer from any infirmity. Challenge to the recovery of amount paid is excess is rejected.

The respondent/Panchayat, Rural Development and Labour, Government of Chhattisgarh shall direct all the Zila Panchayat/Janpad Panchayats and Drawing & Disbursing Officer working therein to apply the Government instructions uniformly, as different application by giving different interpretation to the Government orders have generated confusion and discrepancy giving rise to unnecessary litigations and loss to the exchequer.

The State Government shall circulate copy of this order to all the Zila Panchayats and Janpad Panchayats for implemention.

Henceforth, if any monetary benefit will be paid to any Teacher (Panchayat) cadre, for which he is not entitled, the same shall be recoverable form the concerned Chief Executive Officer of the Zila Panchayat/Janpad Panchayat who has wrongly granted the benefit”

Subsequently, considering order dated 26.09.2014 passed in WPS No.106/2014, the Co-ordinate Bench of this Court vide order dated 17.10.2014 dismissed WPS No.1328 of 2014 along-with other batch of writ petitions.

In view of aforementioned facts of case, issue and subject matter in writ petition has already been considered and decided, this writ petition is also dismissed.
