submitted relevant documents as per guidelines issued by the State Govt. The relevant documents i.e. certificate of a candidate residing in Below Poverty Line and the Voter List showing their place of residence are important documents for considering the candidature to be appointed as Aanganbadi Worker. Under Clause -(1) of the guidelines issued by the State Government dated 27.5.1996, the candidate should be resident of that village panchayat ward where appointment of Aanganbadi Worker is to be made. Requirement of submission of the certificate of residing in Below Poverty Line is also essential document for considering the preference to be granted to the candidate amongst others and further the preference is provided for divorcee lady. Admittedly, the petitioner has not submitted both the documents i.e Voter List and the certificate issued by the competent authority showing the petitioner to be of Below Poverty Line. In absence of mandatory document i.e. Voter List, neither the petitioner nor respondent No.2 could have been appointed, but in the proceedings before the President-in-Council, the petitioner was selected. In appeal, the appointment proceedings initiated by President-in-Council appointing petitioner was set aside by the Collector. Order of Collector is not put to challenge by the petitioner before superior Court. Pursuance to order dated 13.4.2011 (Annexure P-8) of the Collector in appeal under Section 308 of the Act of 1961, the respondents have further initiated proceedings and finding the petitioner to be ineligible, passed order for cancelling her appointment.
