The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.70/2022, registered at Police Station Balodabazar District Balodabazar, for offence punishable under Section 420, 120-B of the IPC.

Prosecution case is that complainant Yogesh Das Manikpuri has lodged a report that co-accused Afzal Khan gave assurance of giving some financial help to the applicant, but in a fraudulent manner purchased the car in his name and the car was used by said Afzal Khan and no amount was paid to him. When notice of the Financial Company was received, the said fact came to the notice of the complainant. So the report was lodged.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. The applicant is the Manager in a Car Showroom and he has no knowledge about the relationship between said Afzal Khan and the complainant. In the regular course of business the vehicle used to be financed by Shriram Finance Company and the applicant has no knowledge about the promise made by the co-accused to the complainant of arranging Rs.1 lakh as loan amount. The applicant is not involved in the said crime.

Per contra, learned State Counsel would oppose the prayer for grant of anticipatory bail.

Having considered the submissions, the nature of accusation, the role attributed to the present applicant, without further commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the applicant.

Accordingly, the Application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:-

(i) he shall not influence the witnesses during trial.

¶22

(ii) he shall make himself available for interrogation by a police officer as and when required;

¶23

(iii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
