The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.214/2022, registered at Police Station Baikunthpur District Koriya, for offence punishable under Section 294, 506, 323, 498 (A) of the IPC.

Prosecution case is that marriage of the complainant was solemnized with the applicant on 6.2.2013 and out of their wedlock, 2 children aged about 7 years and 5 years respectively, were born. After few years of the marriage, the applicant started harassing the complainant on the ground that the average of the motorcycle given in dowry is less so new motorcycle was given by the father of the complainant. Then the applicant started demanding car and father of the complainant also purchased the car and gave to the applicant. Thereafter the applicant

also demanded Rs.5 lakhs to develop his business. When such demand was not fulfilled, the complainant was ousted with false allegations on her character from the matrimonial house on 17^th August, 2021. So the complainant has lodged the report on 10.6.2022.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. The complainant was caught red handed with one Navneet Kashyap and thereafter the dispute arose. In support of the bail application, photographs of the complainant with her boyfriend have been annexed. On coming to know about such relations, the applicant has filed a divorce petition on 12.4.2022 and thereafter to save her esteem, the complainant has lodged the false report. So the applicant may be released on anticipatory bail.

Per contra, learned State Counsel and learned counsel for the Objector would oppose the prayer for grant of anticipatory bail.

Having considered the submissions, the nature of accusation, without further commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the applicant.

Accordingly, the Application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:-

(i) he shall not influence the witnesses during trial.

¶22

(ii) he shall make himself available for interrogation by a police officer as and when required;

¶23

(iii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
