This is third bail application preferred by the applicant/s. First bail application was earlier dismissed as withdrawn by this Court vide order dated 11.08.2020 passed in MCRCA No.563/2020 with a direction to the applicants to fle bail application under Section 439 of the Cr.P.C. for grant of bail before the trial Court. Trial Court was further directed to decide the same probably on the date of its fling itself. Thereafter, second bail application was preferred by the applicants which was dismissed for want of prosecution vide order dated 25.02.2022 passed in MCRCA No.1327/2020.

After arguing at some length, counsel for the applicants submits that he wants to withdraw the present bail application.

In view of the above submission, this application is dismissed as withdrawn.

However, counsel for the applicants again prays for and is granted liberty to fle bail application under Section 439 of Cr.P.C. on behalf of applicant No.2 (Tularam Yadav) before the trial Court.

The trial Court is directed that in the event of surrender of applicant No.2 (Tularam Yadav) before the trial Court and fling of the bail application on his behalf, shall decide the same in accordance with law as early as possible, preferably on date of its fling itself.

Accordingly, this bail application is disposed of.
