1. First bail application of the applicant was dismissed on merits by the co-ordinate Bench of this Court vide order dated 27.08.2021 passed in MCRC No. 5587 of 2021.

The applicant has preferred this Second bail application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 09.10.2020 in connection with Crime No. 99/2020 for offence under Sections 20 (b) ii (c) of NDPS Act, registered at Police Station- Farasgaon, District- Kondagaon (C.G.).

1. After arguing for sometime, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file repeat application after examination of the material witnesses.

1. Counsel for the State has no objection to the above prayer.

1. Accordingly, the instant application is dismissed as withdrawn with the liberty as stated above.
