On due consideration, I am inclined to allow the same. The application is allowed and the delay of 08 days in filing this petition is accordingly condoned. I.A.No.1/2018 stands disposed of. Also heard on an application seeking leave to appeal under Section 378(3) of the Cr.P.C. After examining the impugned judgment dated 30.11.2017, passed by the Special Judge (Prevention of Corruption Act), Durg(CG) in Special Case No.05/2015, I am inclined to allow this application and the Appellant is hereby permitted to prefer an appeal. The Cr.M.P. accordingly stands disposed of. Registry is directed to register the case as regular appeal under the head “Acquittal Appeal” and thereafter, list the same for its admission.
