| None for Non-Applicant No.1. Notice issued earlier to him is still awaited. Shri Ajay Kumar Dwivedi, counsel for Non-Applicant Nos. 2 and 3. Heard on I.A.No.1/2017, an application for condonation of delay of 29 days in filing this petition seeking leave to appeal under Section 378(3) of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'). On due consideration, I am inclined to allow the same. The application is allowed and the delay of 29 days is accordingly condoned. I.A.No.1/2017 stands disposed of. Also heard on an application seeking leave to appeal under Section 378(3) of the Cr.P.C. After examining the impugned judgment dated 31.08.2016, passed by the Additional Judge, Katghora to the Court of Additional Sessions Judge, Katghora, District Korba(CG) in Sessions Trial No.76/2012, I am inclined to allow this application and the Appellant is hereby permitted to prefer an appeal. The Cr.M.P. accordingly stands disposed of. Registry is directed to register the case as regular appeal under the head “Acquittal Appeal” and thereafter, list the same for its admission.
