The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.187/2017, registered at Police Station Ambagarh Chowki, Distt. Rajnandgaon, for the offence punishable under Sections 489A, 489B, 489C, 489D and 489E of the IPC.

Case of the prosecution, in brief, is that the applicant was found in possession of ₹ 10,000/- counterfeit currency of 100/- denomination in 100 numbers and thereby₹ committed the offence under Sections 489A, 489B, 489C, 489D and 489E of the IPC.

Learned counsel for the applicant submits that co-accused Vikram Singh, who is similarly placed, has been released on bail by a coordinate Bench of this Court on 28-2-2018 in M.Cr.C. No.8005/2017. The applicant is in custody since 3-9-2017.

On the other hand, learned State counsel opposes the application.

I have heard learned counsel for the parties and perused the case diary.

Taking into consideration the nature and gravity of offence, facts and circumstances

of the case, long detention of the applicant, charge-sheet has been filed and coaccused Vikram Singh has already been released on bail, I am of the view that it is a fit case to enlarge the applicant on regular bail. Accordingly, the application is allowed.

It is, therefore, directed that the applicant be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court for his appearance as and when directed.
