(1) W.P. No.1676/2003 & W.P. (C) No.443/2009, involve common question of law & facts and, therefore, they are being disposed off by this common order.

(2) These writ petitions are directed against the impugned communication dated 07.04.2003 issued by respondent No. 3- Sub Divisional Officer (Revenue) & Land Acquisition Officer, Bilaspur and also Memo dated 13.09.2002 issued by Sub Divisional Officer (Revenue) & Land Acquisition Officer, Bilaspur seeking approval from the Collector, Land Acquisition for diversion of funds amounting to Rs.44,71,931/- to be paid to the private respondents as additional compensation by diverting the amount from deposit of Rs. 51,83,258/- deposited by the petitioner on 31.3.2003 as advance compensation in relation to other pieces of land of village Kaudiya, Davandih, Darrabhata, Khamariya, Udangi and Kukuba to be distributed to the persons whose lands have been acquired.

(3) Upon issuance of notice, return has been filed by the State opposing the prayer made by petitioners.

(5) First part of the order relates to Case No. 49/B.121/200002 regarding payment of additional compensation against the land acquisitioned whereas Sub Divisional Officer has sought approval from the Collector for diversion of funds amounting to

₹ 44,71,931/- by diverting the amount from deposit of ₹ 51,83,258/- deposited by the petitioner on 31.3.2003 towards advance compensation in relation to acquisition made for other pieces of land of Village Kaudiya and others.

(6) Though only it is a memo by which the approval has been sought from the Collector and no approval has been granted by the Collector.

(7) Since the petition is pending since 2003, it is clarified that the Collector has not granted permission for approval for diverting the amount of compensation deposited by the petitioner as

advance compensation in relation of other pieces of land of village Kodiya & others. No approval granted by the Collector to divert fund has been brought to notice of this Court, therefore, no writ or direction is necessary at this stage. However, the respondent/State and its Authorities will proceed in accordance with law in disbursing compensation to the land owners for which compensation has been deposited.

(8) With the aforesaid observations, writ petitions stand finally disposed of. However, the respondents/land owners are at liberty to proceed in accordance with law.
